1. Introduction

These terms and conditions form part of and are inclusive of all other agreements concluded between members and SAIPA™ regardless of membership type. These terms and conditions shall apply in conjunction with the terms and conditions that may be applicable to any annual subscription that any member may have with SAIPA™ and such member acknowledges that such annual subscription shall exclude any regional/district events of SAIPA™. By accepting these terms and conditions, Members agree to adhere to all clauses stipulated herein, and any amendments made hereto.

2. Annual CPD Subscription Package

2.1 As of 2022, SAIPA Membership Fees will include 20 (twenty) webinars as part of the structured fee. These webinars can only be utilised by booking for any live webinar on your MySAIPA profile. This does not include any items listed on the Shop section of your profile, any regional event or any other event/ listed. Any purchase from the MySAIPA store including CPD webinars will be invoiced to the member and payment must be made immediately.

2.2 Once you have successfully booked for a live webinar on your MySAIPA profile under Menu > Events, 1 (one) credit will be deducted from the available 20 (twenty) webinars. You can verify this by clicking on Menu > Subscriptions > My Subscriptions.

2.3 A CPD Calendar can be viewed here, for planning purposes. If you are unable to attend any of the live webinars you have booked for, the recording, webinar material and assessment of each webinar successfully booked for, will be available on your profile within 24 hours after the live webinar has taken place.

2.4 The 20 (twenty) webinars will only be available to utilise by booking the event before the cut- off date for bookings. Note that a webinar event must be booked even where the member will view later as that is the only way permissible for utilising your subscription. The booking facilitates access to the webinar whether ‘on the day and at the time advertised’ or at a time suited to the user. One credit will be deducted from your 20 bundle and the webinar recording, material and assessment will be available on your CRM platform even if you were unable to attend the live webinar.

2.5 Any webinars booked in addition to the 20 (twenty) that form part of the Membership Fee, will be charged to the account. Invoices can be viewed on your Account of your profile.

2.6 Non-members can purchase a 20 (twenty) Annual CPD Subscription Package once they have created a Non-Member profile. These events will be available to book as live webinars, as well as on the Shop.

2.7 Non-Member to ensure that you book your CPD subscription package on your MySAIPA profile. An invoice will be issued under Accounts > Invoices. Once payment has been received, your profile will be updated to “Subscriber” status once payment has been allocated, before you will be able to book and attend events. The Annual CPD Subscription Package is only available until 31 March each year.

2.8 Failure to make payment within the prescribed period stated shall cancel the tax invoice supplied and the Annual CPD Subscription Package will be cancelled. Non-Members will then be invoiced per seminar booked and will be liable for money owed to the Institute. There will be no extensions offered and the Annual CPD Subscription Package will not be available for booking or payment after 31 March of each year. This does not apply to any additional CPD Packages, other than the Annual CPD Subscription Package.

2.9 Subscribers acknowledge that the Annual CPD Subscription Package options do not include access to other SAIPA™ events such as, but not limited to, Accounting iNdaba and Budget Breakfast, face-to-face CPD workshops) or any of the regional events. All other events will be advertised, priced and invoiced separately.

2.10 Non-attendance of events during the subscription year will NOT result in a refund of the subscription paid and no unused events will be carried over to the following year.

2.11 Subscribers acknowledge that once an option is selected online when registering for a webinar, the subscriber is liable for the fees associated with the subscription

2.12 Events must be attended by the member in whose name it has been purchased. Under no circumstances may members nominate proxies to attend events on their behalf. Annual CPD Subscription Package Subscribers who let anyone else attend any SAIPA events on their behalf, will be liable for a fine of R1000 per event, in addition to being compelled to attend a 2-hour Ethics webinar. In addition, Members will be reported to the Institute’s Investigation and Disciplinary Committees, which could affect their Good Standing Status.

2.13 A maximum of 20 (twenty) events can be selected when purchasing the Annual CPD Subscription Package. As some webinars are repeated and presented live at least twice, you are only able to claim CPD hours for one of these sessions. Booking the same topic more than once does not count towards your webinar allocation.

2.14 Free webinars are NOT included in the maximum of 20 (twenty) events on the Annual CPD Subscription Package

2.15 Registering and paying for the Annual CPD Subscription Package does NOT mean a member is automatically booked or confirmed for any event. Members/Non-Members need to successfully register for any of the events available by logging on to their MySAIPA profile at least 5 days prior to the event start date.

3. Webinars

3.1 All webinars are conducted by SAIPA™ solely in terms of these terms and conditions and in this regard no contrary declarations, undertakings, or agreements, whether oral or in writing and regardless of whether same is made by an employee, agent or representative of SAIPA™, shall be of any force and effect especially in circumstances where such declaration, undertaking or agreement is contrary to any provision contained in these terms and conditions.

3.2 Members seeking to attend webinars are required to register for the desired webinar on the MySAIPA online platform. Upon registration, members shall be invoiced for such webinar except in circumstances where the webinar in question is offered free of charge or in circumstances where the particular member is an annual subscriber. Once registration is completed, an invoice will be issued to the Account of the member on their profile.

3.3 All amounts invoiced in respect of webinars are due and payable immediately upon issuance of such invoice. Members are required to pay for webinars through any one of the various payment methods provided on the MySAIPA platform.

3.4 Registration to attend webinars will only be completed and attendance permitted at such webinar upon receipt of payment for such webinar. Proof of payment, with membership number as reference, must be issued to debtors@saipa.co.za

3.5 In the event of a webinar unable to commence on the date and/or time at which the webinar was scheduled to commence due to circumstances beyond the control of SAIPA™, then such webinar shall be re-advertised and rescheduled to a date and time at which the webinar will be capable of proceeding on. It will however remain each member’s own responsibility to ensure that they re-register for the webinar on the rescheduled date on the MySAIPA platform.

3.6 Any views, opinions or thoughts expressed by the presenter of any webinar, regardless of whether the presenter is an employee or representative of SAIPA™, remain views, opinions or thoughts of the presenter in question in their personal capacity and are in no way and should not be construed as the views, opinions or thoughts of SAIPA™.

3.7 The content of all materials contained and presented in webinars (in particular, course and continuing education materials, offers, reports, analyses, expert opinions, organisational plans, programmes, performance reports, drafts, calculations, drawings, data carriers, etc.) is and remain the sole intellectual property of SAIPA™ or the presenter in question. The duplication and distribution of such materials is only permissible upon the prior express and written authorisation of SAIPA™. In the case of a violation of these stipulations, the member and/or webinar attendee shall pay to SAIPA™ a royalty which shall be determined by SAIPA™ in its sole discretion. SAIPA™ further expressly reserves the right to claim further damages that may arise as a consequence hereof. In addition, Members who have been found infringing on this rule, will be compelled to attend a 2-hour Ethics webinar and will be reported to the Institute’s Investigation and Disciplinary Committees, which could affect their Good Standing Status.

4. Cancellations

4.1 Cancellations of any events booked for using the Annual CPD Subscription Package, to be made at least 5 days prior to the event starting date, in order to avoid the webinar being deducted from your 20 webinar credits and or receiving an invoice or being liable for the webinar fee.

4.2 The terms and conditions relating to the cancelation of free webinars and the consequences in respect thereof will apply mutatis mutandis to annual subscribers.

4.3 In the case of webinars offered free of charge, should a member seek to cancel their registration in respect thereof, the member will be required to cancel his/her registration for such webinar within 5 days before the date and time at which the webinar was scheduled to commence, failing which the member will become liable for and agrees to pay the amount equal to the cost charged by SAIPA™ in respect of webinars from time to time. In addition thereto, should a member fail to attend a free webinar for which he/she has registered, the member will become liable for and agrees to pay the amount equal to the cost charged by SAIPA™ in respect of webinars from time to time.

4.4 Subject to the provisions of clauses 4.2 and 4.3 above, the recording of all webinars will be supplied to the attendees thereof after the completion of the webinar.

4.5 Where a member cancels his/her registration within the abovementioned 5-day period, the cost of the cancelled webinar will be credited to the member’s MySAIPA account. Should a member seek a refund of the registration fee in respect of the webinar registered for, the member will be required to cancel his/her registration for such webinar within 5 days from the date at which the webinar was scheduled to commence in accordance with the standard terms and conditions of membership with SAIPA™.

5. CPD Assessments

5.1 Upon successful completion of an assessment after attending events hosted by SAIPA™, CPD Hours will automatically be uploaded to a Member’s MySAIPA profile. (Members should not log any SAIPA assessed event on their Profile). This can be viewed on Good Standing Report.

5.2 Should all three (3) attempts be unsuccessful, a maximum of 10% of the CPD Hours will be awarded to the Member’s CPD Compliance on their MySAIPA profile.

6. General

6.1 By virtue of being a SAIPA™ member and/or a subscriber to the Institute’s programmes, the subscriber consents and grants SAIPA™ permission to advertise upcoming events via their mobile contact number or email address that is reflected in their membership profile.

6.2 Subscribers acknowledge that their information may be stored in an electronic format with a third-party cloud services provider which may be located outside the territory of the Republic of South Africa, in accordance with SAIPA™’s Privacy Policy.

6.3 Connecting to local WIFI networks and other electrical and/or charging points is at the risk of the user. SAIPA™ limits all liability and does not warrant nor guarantee against any malware, virus, or cyber hacking.

7. SAIPA Regional Events

These terms and conditions form part of and are inclusive of all other agreements concluded between members and SAIPA™ regardless of membership type and shall be applicable to any annual subscription that any member may have with SAIPA.

7.1 Payment

7.1.1 Events hosted by any of the 5 x SAIPA™ Regions, are not included in the SAIPA™ Annual CPD Subscription Package and the cost thereof cannot be deducted from a credit balance on your SAIPA account. This includes SAIPA Northern Region, SAIPA Eastern Region, SAIPA Southern Region, SAIPA Western Region and SAIPA Central Region.

7.1.2 The booking option will not be enabled if a member/delegate has an outstanding balance on their Annual Membership Fees, Annual CPD Subscription Package or outstanding balances for any other SAIPA Region.

7.1.3 All amounts invoiced in respect of events (seminar, webinar, forum, etc) are due and payable immediately upon issuance of such invoice. Members are required to pay for the event through EFT or with a debit or credit card or scan with Zapper, as these payment methods are provided on the MySAIPA platform for ease of reference.

7.2 Event (Webinar, seminar, forum, hybrid, etc)

7.2.1 If the event is unable to commence on the date and /or time at which the event was scheduled to commence due to circumstances beyond the control of SAIPA™, then such event shall be re-advertised and rescheduled to a date and time at which the event will be capable of proceeding on. It will however remain each member’s own responsibility to ensure that they re-register for the event on the rescheduled date on the MySAIPA platform.

7.3 Cancellation

7.3.1 Should a member register to attend an event and should such member seek to cancel such registration, the member in question will be required to cancel his/her registration to attend such event on the MySAIPA platform within 5 days before the date and time at which the event was scheduled to commence. Should a member fail to cancel his/her registration within the aforesaid period, such member will remain liable for the full cost of the event in question and the recording (if applicable) thereof which will be made available to the member who shall have an opportunity to complete the assessment in respect thereof.

7.3.2 Where a member cancels his/her registration within the abovementioned period, the cost of the cancelled event will be credited to that member’s relevant MySAIPA account. Should a member seek a refund of the registration fee in respect of the event registered for, such member will be required to cancel his/her registration for such event within 7 days from the date at which the webinar was scheduled to commence in accordance with the standard terms and conditions of membership with SAIPA™.

7.4 Personal Information

7.4.1 Company, contact and any other details, as provided by the Member, are held on a central database and are deemed as being true and correct. It shall be the Member’s responsibility to update the information on the website via the MySAIPA portal.

7.5 Presenter and Content

7.5.1 Any views, opinions or thoughts expressed by the presenter of any event, regardless of whether the presenter is an employee or representative of SAIPA™, remain views, opinions or thoughts of the presenter in question in their personal capacity and are in no way and should not be construed as the views, opinions or thoughts of SAIPA™.

7.5.2 All intellectual property is owned by or licensed to SAIPA and may not be used without our prior written consent.

7.6 Code of Ethics

7.6.1 You acknowledge that you have read, understood and agree to be bound by SAIPA’s Code of Ethics and Standards of Professional Conduct.
