SAIPA Privacy Policy

This is the official Privacy Policy of the South African Institute of Professional Accountants (hereinafter referred to as SAIPA) who is the registered owner and copyright holder of the web domain "saipa.co.za". From time to time, we may change this Privacy Statement. For example, as we update and improve our service, new features may require modifications to the Privacy Policy. If you use this website or any of the services or facilities offered by SAIPA after SAIPA has displayed a change to this privacy policy, you will be deemed to have agreed to the change.

SAIPA believes that privacy is important to the success and use of the Internet. This statement sets forth SAIPA's Privacy Policy and describes the practices that SAIPA will follow with respect to the privacy of users of this site and all your personal information in our possession. We value the information that you choose to provide us with and will therefore take reasonable steps to protect your personal information from loss, misuse or unauthorised alteration. The information we maintain concerning our members is stored in databases that have built-in safeguards to ensure the privacy and confidentiality of that information.

Any information about what you buy, where you shop, where you bank, how you invest and all related information will also be regarded as personal information. In short, any information that we know about you will be regarded as your personal information. Personal information is further defined in the Electronic Communications and Transactions Act 25 of 2002.

Why and How we collect and use Personal Information

In order to make your use of this website helpful, valuable and as pleasant as possible, it is necessary for us to find out exactly what you need from us. The following are reasons (i.e. disclosed reasons) why we would collect your personal information:

  • in order for us to process your instructions or requests;
  • in order for us to ensure that we meet your needs, we may collect and analyse your personal information and, with your express consent, combine all the information that we have about you to compile a profile of you in order for us to personalise and tailor our services to meet your specific needs;

    The South African Institute of Professional Accountants and its affiliates (collectively "SAIPA") authorises you to use this website subject to the terms and conditions below ("the Terms and Conditions"). Any unauthorised alteration, modification, copying, reproducing, republishing, framing, uploading to third parties, transmitting, distributing or using the contents, information or materials on this website, except as expressly provided in these Terms and Conditions or applicable intellectual property laws, is rigorously prohibited.

  8. Refund Policy

    1. SAIPA is a membership-based Institute and all payments made to SAIPA are in the form of membership fees, CPD Seminar registrations and Profession Evaluation (PE) registrations.

    2. A refund will only be payable in the following circumstances:

      1. Where an applicant has not met the required academic and/or practical qualifications necessary to write the PE.

      2. Where a person has notified SAIPA at least 48 hours prior to the actual date of a CPD seminar in writing, of cancellation of such CPD registration.

      3. Where a CPD Seminar has been cancelled by SAIPA.

    3. Refunds are not payable on Membership Fees i.e. application, entrance and/or annual fees as applicable to full or associate members of SAIPA.

  9. Links to and from this website

    1. This Site does contain links that will let you access other Web sites that are not under the control of SAIPA. SAIPA assumes no responsibility or liability for any material that may be accessed on other Web sites reached through this Site, nor does SAIPA make any representation regarding the quality of any product or service contained at any such site. Any concerns regarding any such service or resource, or any link thereto, should be directed to the particular service or resource.

    2. SAIPA, its affiliates, subsidiaries, employees, service providers and/or agents do not endorse and are not responsible or liable for the contents, maintenance of, or activities conducted on, any website to which this website provides a link.

  10. Member Account

  11. If you register as a SAIPA user, you will be assigned a username and password that is unique to you. You are responsible for maintaining the confidentiality of the username and password, and responsible for all activities that occur under your username and password. You agree to notify SAIPA of any unauthorised use of your username and password or any other breach of security.

  12. E-mail and public communication

    1. "Medium" means letters, e-mails or other types of communications to the editors, Webmaster(s) or employees of SAIPA, and messages posted in connection with the SAIPA discussion forum. You shall not upload to, distribute through, or otherwise publish through a Medium on this website or any other website any content which is libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable that would constitute or encourage a criminal offence, violate the rights of any party, or that would otherwise give rise to liability or violates any law.

    2. The Mediums shall be used only in a non-commercial manner. You shall not, without SAIPA's express approval, distribute or otherwise publish any material containing any solicitation of funds, promotion, advertising, or solicitation for goods or services. You specifically acknowledge that soliciting other guests of the SAIPA website to join or become members of any commercial online or offline service or other organisation is expressly prohibited.

    3. Therefore, subject to the terms of the law, in general, we will not monitor or edit or disclose the contents of Medium materials unless required in the course of normal maintenance of the SAIPA website and its systems or unless required to do so by law or in the good-faith belief that such action is necessary to:

      1. comply with the law;

      2. protect and defend the legitimate business interests, rights or property of SAIPA, it's users, advertisers, customers, sponsors, advertisers or affiliates;

      3. in an emergency to protect the personal safety of our guests or the public.

    4. Users shall remain solely responsible for the content of their communications. SAIPA has the right but not the obligation to monitor and edit or remove any Medium communications and content.

    5.   14. Termination

    1. SAIPA shall terminate the Terms and Conditions immediately without notice if, within SAIPA's sole discretion, you fail to comply with any term or provision of the Terms and Conditions.

    2. Upon termination, you must destroy all materials obtained from the SAIPA website and all copies thereof, whether made under these Terms and Conditions or otherwise.

    3. SAIPA may take such further action as SAIPA may determine to be appropriate under the circumstances to eliminate or preclude repeat violations, and SAIPA shall not be liable for any damages of any nature suffered by any customer, member, user or any third party resulting in whole or in part from SAIPA's exercise of its rights under these Terms and Conditions.

  15. Jurisdiction

    The terms and conditions that have been set forth shall be governed and construed in accordance with the laws of South Africa and any disputes arising shall be exclusively subject to the jurisdiction of the courts of South Africa as they apply to agreements made and solely performed therein.

  16. Severability

    If any one or more of the provisions of these Terms and Conditions should be held to be invalid or unenforceable, the validity and enforceability of all the other provisions of these Terms and Conditions will not be affected thereby and shall continue in full force and affect.
